Return and Refund Policy

These General Terms and Conditions govern the purchase of products offered through the website owned by Enriqueta Heredia Torres, with tax ID (NIF) 26002117L, domiciled at c. Sant Jordi, 2; hereinafter referred to as "THE COMPANY".

In this document, "THE USER" refers to the individual who purchases the product offered through the website, and "THE COMPANY" refers to us. Products are purchased directly from THE COMPANY, which acts as the direct seller; therefore, the sales contract is established between THE USER and THE COMPANY. THE USER must read and accept these General Terms and Conditions and the information about the products they wish to purchase before proceeding with the purchase. This acceptance will be made expressly by clicking the box "I have read and accept the General Terms and Conditions" that will appear during the purchase process. By doing so, THE USER confirms they are of legal age and have the legal capacity to acquire the products offered by THE COMPANY.

At the moment the purchase is formalized, it will be considered fully perfected by law, and from that instant, prices and conditions will have contractual effect and may only be modified by the express agreement of the contracting parties.
The electronic document that formalizes the contract will be stored by THE COMPANY for one year, and THE USER may obtain a copy within this period.

1. USER OBLIGATIONS

THE USER agrees to use the website and, if applicable, to purchase the products offered by THE COMPANY in accordance with the law and these General Terms and Conditions.
THE COMPANY reserves the right to remove from the website any comments or opinions from USERS that are contrary to current law, especially those that violate the fundamental rights and freedoms of individuals.

2. PURCHASE PROCEDURE AND PAYMENT METHOD

THE USER will select on the website the products they wish to purchase and the quantity or number of units. Prices shown are in euros and are current, except in case of typographical errors, with an indication of whether applicable taxes are included.
The USER must fill out the form with their details to process the order, click "Continue" to proceed with the purchase, and expressly accept these General Terms and Conditions. On the next page, THE USER will see a summary of the products to be purchased, the price, applicable taxes, shipping costs, and estimated delivery time, and may make any changes before clicking "Pay."
When clicking "Pay," THE USER must enter their credit card details or PayPal account information and accept the payment.
THE COMPANY will send an email to THE USER confirming receipt and confirmation of the purchase within 24 hours of receiving the order. The contract will not be considered finalized until THE COMPANY receives payment.
If THE USER wants an invoice, they can request it by email from THE COMPANY.
THE USER is responsible for the accuracy of the personal data provided and guarantees that the credit or debit cards used are their own and have sufficient funds to cover the purchase. THE COMPANY reserves the right to cancel the sale in case of non-payment, chargeback, card denial, false data, or inability to verify card details. THE USER must notify THE COMPANY by email immediately upon detecting any unauthorized or fraudulent charge on the card used.

3. RIGHT OF WITHDRAWAL

In accordance with Articles 102 and following of Royal Legislative Decree 1/2007, November 16, approving the consolidated text of the General Law for the Defense of Consumers and Users and complementary laws, YOU, as a consumer or user as defined in Article 3, have the right to withdraw from the purchase for any reason within 14 calendar days from receipt of the product.
However, as set out in the following section "EXCEPTIONS TO THE RIGHT OF WITHDRAWAL," this right does not apply to the goods and services specified there.
To exercise the right of withdrawal, YOU must notify your decision to withdraw via an unequivocal statement sent by postal mail or email to the addresses listed at the beginning of these General Terms and Conditions. You may use the following form:

THE COMPANY only accepts returns that meet the following conditions:

  • The product must be in its original packaging and with labels intact.

  • The shipment must be made in the same box in which the order was received.
    If this is not possible, YOU must use a box that guarantees protection of the contents so they arrive at THE COMPANY in good condition; otherwise, THE COMPANY reserves the right to reject the return.

  • Include a copy of the invoice/delivery note inside the package, indicating the products being returned.

The product must be returned to THE COMPANY at the address listed above. Return shipping costs will be borne by THE USER, who may choose their preferred shipping company and calculate costs here:

Once the product is received and verified to be in perfect condition, the refund will be processed within 14 calendar days from the date the user communicated their withdrawal intention, using the same payment method. THE COMPANY may withhold the refund until the returned items are received.

EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

As established in Article 103 of Royal Legislative Decree 1/2007, November 16, the right of withdrawal does not apply to contracts relating to:

  • Services fully performed once execution has begun with the consumer’s prior express consent and acknowledgment that withdrawal is lost once the contract is fully performed.

  • Supply of goods or services whose price depends on financial market fluctuations outside the seller’s control during the withdrawal period.

  • Goods made to consumer specifications or clearly personalized.

  • Goods liable to deteriorate or expire rapidly.

  • Sealed goods not suitable for return due to health or hygiene reasons once unsealed after delivery.

  • Goods that are inseparably mixed with other items after delivery due to their nature.

  • Alcoholic beverages with agreed price at the time of sale that cannot be delivered before 30 days and whose value depends on market fluctuations outside the seller’s control.

  • Contracts where the consumer specifically requests urgent repair or maintenance visits; if additional services or goods are provided beyond the original request, withdrawal rights apply to these extras only.

  • Sealed audio, video recordings, or software unsealed by the consumer after delivery.

  • Daily newspapers, periodicals, or magazines, except subscription contracts.

  • Contracts concluded at public auctions.

  • Accommodation services (other than for residential purposes), transport of goods, car rental, catering, or leisure activities with a specified date or period of execution.

  • Digital content not supplied on a tangible medium where execution began with the consumer’s prior express consent and acknowledgment of loss of withdrawal rights.

4. RETURNS

  • For damages during transport or shipping errors:
    If upon delivery it is visibly clear, without opening or manipulating packaging, that a product is damaged or the wrong goods were received, YOU must notify THE COMPANY by email within 24 hours of receipt to arrange return and replacement or refund.

  • For defective products:
    If, after opening the package, THE USER finds a defect, they must notify THE COMPANY by email and return the product within 7 calendar days of receipt. In justified cases, THE COMPANY will refund the product value, shipping costs, and direct return costs within 30 days of receiving the returned product.

This is without prejudice to mandatory consumer protection laws.

5. WARRANTY

THE COMPANY will be liable for non-conformities appearing within two years from delivery. For second-hand products, this period is one year.
THE USER must notify THE COMPANY of non-conformity within two months of becoming aware of it. Warranty does not cover damage caused by improper use or normal wear and tear.

6. CUSTOMER SERVICE

For any communication, incident, or claim, THE USER may contact THE COMPANY by email.

7. INVALIDITY OF CLAUSES

If any clause in these terms is declared null or ineffective in whole or in part, only that clause or part will be affected; the rest will remain valid.

8. NOTIFICATIONS

Any notifications related to product contracts or these Terms must be in writing and will be deemed properly made if sent to the email each party designates.

9. APPLICABLE LAW AND JURISDICTION

These Terms shall be governed and interpreted according to the laws of Spain.
THE COMPANY reserves the right to make changes at any time to the website and these Terms. Changes to essential elements will not affect existing contracts unless the user expressly accepts the modified terms.

10. INFORMATION ABOUT DISPUTE RESOLUTION

THE COMPANY reserves the right to change the website and these Terms at any time. Changes will not affect existing contracts unless expressly accepted by the user.
